General condition

The following general contractual conditions are valid for all the orders placed with Si.Box S.r.l. Any other agreements are not binding unless they have been expressly recognised in writing by Si.Box S.r.l.

The conditions below are deemed to be accepted when the order is placed.

Offers and documentation

Si.Box S.r.l. undertakes to formulate all offers in written form which will be valid for 30 days from the date of issue of the estimate, unless otherwise agreed with the client.

Si.Box S.r.l. reserves the right of exclusion and the rights to all the offer documentation. Disclosure to third parties of all documentation is expressly prohibited.

Orders

Orders shall be accepted by Si.Box S.r.l. only if sent in writing and each part is filled out.

Verbal and/or telephone agreements are not binding for Si.Box S.r.l.

No order may be cancelled without the authorisation of Si.Box S.r.l., which reserves the right to charge for any expense deriving thereof.

Amendments or cancellations of orders for standard or special materials (special size, particular silkscreening, coloured) are not accepted.

Orders can also be partially fulfilled by Si.Box S.r.l.

Prices

The prices in the order confirmation are expressed in euros, unless otherwise specified and are VAT excluded.

If the total amount of the order exceeds €600,00 excluding VAT, a 5% transport cost contribution will be charged. If the amount is less than €600,00 excluding VAT, the charge will be €30,00 excluding VAT.

The prices indicated do not include additional costs and charges, such as: transport, taxes, bank commissions, installations, maintenance, etc. which will be borne by the buyer.

The price confirmed in the order by Si.Box S.r.l. shall be binding only until the delivery date stated in the order confirmation. Should the costs of materials increase in the period from contract being stipulated to its execution, Si.Box S.r.l. reserves the right to amend the prices accordingly.

Delivery conditions and times

The delivery date indicated in the order confirmation is purely indicative and not binding. In no case can any delays not due to Si.Box S.r.l. constitute a pretext for delays, missed payments or requests for compensation for damages.

Due to force majeure, Si.Box S.r.l. may extend production and delivery times, compared to the date indicated in the order confirmation, for the time necessary to fully resolve the supervening events. This includes, due to force majeure, strikes, transport blockages, holidays, work suspensions and difficulties in procuring raw materials for production.

The agreed delivery time shall be observed if each part of the order has been completed and the principal has fulfilled his payment obligations.

In accordance with art. 1510 of the Civil Code, the goods travel at the principal’s risk even when they are shipped at the expense of Si.Box S.r.l.

Upon delivery, whether by courier or direct transport by Si.Box S.r.l., the goods must be checked immediately by the customer. Incomplete or damaged deliveries must be noted on the transport document with signature, documented with clear photos and communicated in writing within 8 days to Si.Box S.r.l.

Payment conditions

The payment terms are agreed in advance between Si.Box S.r.l. and the customer and are reported in the order confirmation.

For orders with an amount less than €200,00 excluding VAT, invoicing will be by advance bank transfer.

In the event of missed payments, Si.Box S.r.l. is not obliged to carry out the delivery of the current order or for other orders in progress.

We do not accept payment methods such as: bills of exchange, bank checks and cash on delivery.

In the event that facts are discovered that cast doubt on the client’s credit, Si.Box S.r.l. reserves the right to request immediate payment.

Warranty

Si.Box S.r.l. guarantees its shower enclosures for 24 months from the date of delivery to the sales outlet. This does not include the glass parts. The warranty covers any parts that are faulty on account of defective manufacture and/or the replacement of faulty parts only. Any additional claims made by the principal are not covered.

The warranty obliges Si.Box S.r.l. only to repair and/or replace defective parts; other claims by the customer are excluded.

The warranty does not cover damage caused by improper use or assembly of the product, or damage caused by shipment.

The warranty does not cover products to which modifications, repairs or replacements have been made that are not authorised in writing by Si.Box S.r.l., thereby releasing it from any claims by the customer.

The warranty does not cover elements subject to wear such as: all types of gaskets, sliding carriages, hinges and handles. Breakage of tempered glass is not covered by the warranty.

Withdrawals and repairs

Withdrawals and/or returns are not permitted unless agreed between the parties and only with a written request to Si.Box S.r.l.

Products labelled as made to measure and/or special (colours, silkscreen prints, non-standard heights, etc.) are excluded from collection and/or return.

The return of goods must be previously agreed in writing with Si.Box S.r.l.

The collection of goods for extraordinary maintenance must have an order confirmation and the request must be made to Si.Box S.r.l. in written form.

Right of ownership

The goods shall remain the property of Si.Box S.r.l. until they have been paid for completely (art. 1523 seg. CC).

Catalogues, leaflets, projects and more

The photos in the catalogue are not binding and are purely indicative. ny components may not reflect reality for technical reasons in the creation of the graphics. The shower enclosures are made of different materials such as aluminium, steel, tempered crystal, methacrylate and synthetic materials. Si.Box reserves the right to replace these elements with others of equal or higher quality and to make changes in conjunction with the technical development of the products.

The opening solutions shown schematically in the catalogue are the standard ones. For any alternatives, requests in written form and following an inspection are accepted.

Si.Box S.r.l. shall not be liable for any printing errors, which in any case shall not constitute a reason for claims.

Executive headquarters and competent court

The executive headquarters for each delivery and payment is Cessalto (TV).

Italian Law applies to all the contracts stipulated between Si.Box S.r.l. and its contracting parties and to all consequent rights.

Treviso Law Court shall be the sole competent court for any disputes arising from a contract in accordance with art. 17 of the Bruxelles Convention.

Privacy

Pursuant to and for the purposes of GDPR n° 2016/679, Si.Box S.r.l. declares that the data made available by the client will be processed in compliance with the privacy law and specifically only for purposes relating to current or future legal transactions.
